Welcome to SurgePay ("SurgePay", "we", "our", "us"). SurgePay is a financial technology platform that enables users to create digital wallets, send and receive funds, convert currencies, and access blockchain financial services.

By downloading, accessing, or using the SurgePay mobile application or related services (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Services.

2. Eligibility

You must:

  • Be at least 16 years old.
  • Have legal capacity to enter into a binding agreement.
  • Comply with all applicable laws and regulations.

SurgePay may restrict or deny access in certain jurisdictions.

3. Account Registration

To use SurgePay, you must create an account and provide accurate, complete information. You agree to:

  • Keep your credentials secure.
  • Notify us immediately of unauthorized access.

You are responsible for all activities conducted through your account.

4. KYC, Compliance & Verification

SurgePay complies with applicable AML, CFT, and KYC regulations. You authorize us to:

  • Collect and verify identity information.
  • Share information with verification partners.
  • Suspend or terminate accounts that fail compliance checks.

5. Services Description

SurgePay may provide:

  • Digital wallets (fiat and stablecoin-based).
  • Peer-to-peer transfers.
  • On-chain crypto transactions.
  • Currency conversion.
  • Off-ramp and on-ramp services.
  • Virtual or physical payment cards (via partners).

Services may change, be limited, or be discontinued at any time.

6. Fees

Fees may apply for certain transactions or services. Applicable fees will be disclosed in-app or prior to execution. SurgePay reserves the right to update fees with notice.

7. Prohibited Activities

You agree not to use SurgePay for:

  • Fraud, money laundering, or terrorist financing.
  • Illegal goods or services.
  • Circumventing sanctions or regulations.
  • Exploiting or attempting to breach system security.

Violation may result in suspension, termination, or reporting to authorities.

8. Transaction Finality

Blockchain and financial transactions are irreversible once completed. SurgePay is not responsible for losses caused by incorrect addresses, user error, or network failures beyond our control.

9. Account Suspension & Termination

We may suspend or terminate your account if:

  • You breach these Terms.
  • Required by law or regulation.
  • Risk or fraud concerns arise.

Remaining balances may be held or released subject to compliance obligations.

10. Intellectual Property

All content, trademarks, software, and materials related to SurgePay are owned by or licensed to SurgePay. You may not copy, modify, or distribute without permission.

11. Disclaimers

SurgePay is provided "as is" and "as available". We do not guarantee uninterrupted or error-free service. Cryptocurrency and financial services involve risk.

12. Limitation of Liability

To the maximum extent permitted by law, SurgePay shall not be liable for indirect, incidental, or consequential damages, including loss of funds due to user error or third-party failures.

13. Governing Law

These Terms are governed by the laws of the applicable jurisdiction where SurgePay operates, without regard to conflict of law principles.

14. Changes to Terms

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of the updated Terms.
